    LA EFICACIA DE LAS MEDIDAS DE PROTECCIÓN JUDICIAL CONTRA LA VIOLENCIA FAMILIAR EN EL DISTRITO DE BAMBAMARCA-CAJAMARCA-2017.

    El estudio que se aborda tuvo como objetivo demostrar la eficacia de las Medidas de Protección Familiar adoptadas judicialmente en el distrito de Bambamarca-Cajamarca 2017 está en el seguimiento judicial, para ello se analizaron los 53 casos tramitados por el Primer Juzgado de Familia de dicha ciudad, esto nos ha conllevado a analizar las limitaciones de la Ley N° 30364 en cuanto a la efectividad en su aplicación de los mecanismos de protección de la familia. Para ello se describirá el seguimiento judicial de las medidas de protección familiar contra la violencia familiar. Dado que según los resultados obtenidos estas medidas de protección son ineficaces porque no se tiene una reducción de casos de agresiones físicas y psicológicas, no existe una adecuada coordinación entre el Ministerio Público y la Policía Nacional, así como también hemos podido observar que no existe control y registro adecuado no solo de los otorgamientos de las medidas de protección familiar en todos los casos que lo ameritan ni mucho menos existe control y registro del seguimiento de las medidas adoptadas. Esta problemática es muy delicado porque no solo en el distrito de Bambamarca los casos de violencia familiar va en aumento sino en todo el país de allí que es importante evaluar el nivel de eficacia para ello se elaboró fichas de observación documental de los casos existentes de violencia familiar, ya que es el instrumento más utilizado para recolectar los datos. Queda demostrado que las medidas de protección judicial serán eficaces en la medida que se realice el seguimiento judicial.

    The objective of this research is to determine the role of the social worker against domestic violence in the homes of the Barrio de Agomarca Alto, in the city of Bambamarca, an investigation that was carried out in 2017, because there are many people inside of the family, especially women who suffer the consequences of being married or living with a violent person; There are many factors that increase cases of domestic violence such as lack of economic resources, lack of work. The victims suffer different types of violence, mostly physical and psychological, in addition to this it was found that if they receive the help and guidance of social workers To obtain the results they worked with a total of 60 people within a universe of 600, applying a Survey all of them. In Bambamarca, there are different institutions that fight against family violence, however, it was found that many of the respondents express their refusal to go to them every time they have distrust, since they do not carry out a follow-up control to the protection measures dictated by the family judge and usually the aggressor assaults them again, so it has been possible to determine the role of the social worker in the face of domestic violence, which is to provide specialized counseling, counseling, social therapy and of social rehabilitation to the victims and according to the respondents if they comply.
